Welcome to CostcutIndustrial.ca (operated by RMT Industrial Sales Ltd). These Terms & Conditions govern access and use of Costcutindustrial.ca, including any purchases you make. By using the Website and/or placing orders, you agree to these Terms.
If you do not agree to these Terms, please do not use the Website or make purchases.
Eligibility & Capacity
- You must be at least 18 years old (or meet the legal age in your jurisdiction) and have the legal capacity to enter into contracts.
- If you are ordering on behalf of a company or business, you represent that you have the authority to bind that entity to these Terms.
Account, Registration & Security
- You may (optionally) create a login to facilitate ordering, track orders, and save preferred products.
- You are responsible for maintaining the confidentiality of your account credentials (username, password).
- You agree to notify us immediately if you become aware of any unauthorized use of your account or any breach of security.
- We reserve the right to suspend or terminate accounts for misuse, fraud, or violation of these Terms.
Orders, Acceptance & Contract Formation
- When you place an Order, you are making an offer to purchase Products under these Terms.
- We reserve the right to accept or decline any Order—in full or in part—for any reason (e.g. stock unavailability, pricing error, suspected fraud).
- If we accept your Order, we will send you an Order confirmation email. That confirmation constitutes the formation of the Contract.
- Before shipment, you may cancel or modify your order, subject to conditions. After shipment, cancellation is subject to return and cancellation policies.
Pricing, Taxes & Payment
- All prices on the Website are in Canadian dollars (CAD), unless otherwise stated.
- Prices exclude applicable taxes.
- Payment methods accepted: [Credit Card, Interac e-transfer, Business Purchase Orders with account terms, etc.]
- We may require verification, credit approval, or other checks before fulfilling certain Orders.
- In the event of pricing or typographical errors, we reserve the right to correct the error, refuse or cancel the Order, or require you to pay the correct amount.
Minimum Order

Returns, Refunds & Cancellations
- All returns, refunds, and cancellations are governed by our separate Refund & Returns Policy (linked on the Website).
- Defective or incorrect Products may be returned (at your cost unless we agree otherwise) for replacement or refund, at our discretion, subject to inspection.
- Custom, special-order, or non-stocked items may not be returnable unless defective or unless we expressly agree.
- Cancellation of Orders before shipment may be permitted; once shipped, cancellation may be refused or subject to restocking fees or return shipping.
- Any approved refunds will be issued by the same method you used to pay.
Warranty, Disclaimers & Limitation of Liability
- Products may carry warranties as provided by manufacturers. We will pass through any such warranties (if transferable) to you to the extent possible.
- EXCEPT TO THE EXTENT REQUIRED BY LAW, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE (including warranties of merchantability, fitness for a particular purpose, or noninfringement).
- In no event will we (or our affiliates, employees, agents) be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, business interruption, loss of goodwill) arising out of or relating to your use of or inability to use the Website or Products.
- Our total liability (and your exclusive remedy) under or arising from the Contract is, at our option, limited to: (a) replacing the Product, (b) refunding the purchase price you paid for the Product, or (c) repair of the Product.
- Some jurisdictions do not allow exclusion of incidental or consequential damages, so some portions of this limitation may not apply to you to the extent prohibited by law.
Intellectual Property
- All content on the Website (text, images, graphics, logos, product data, software code) is owned by or licensed to Costcutindustrial.ca and protected by copyright, trademark, and other intellectual property laws.
- You may use the content only for your personal or business ordering use — you may not reproduce, distribute, republish, modify, or create derivative works without express written consent.
User Conduct & Prohibited Activities
You agree not to:
- Use the Website for any unlawful, fraudulent, or abusive purpose;
- Interfere with or disrupt the Website or servers or networks connected to the Website;
- Attempt to gain unauthorized access to other accounts, systems, or networks;
- Use bots, spiders, scrapers, or other automated means to access the Website except with our prior written permission;
- Upload, post, or transmit any content that is harmful, defamatory, infringing, or otherwise objectionable;
- Violate any applicable laws or regulations.

- The Website may contain links to third-party websites, services, or content. We do not control, endorse, or assume responsibility for those third-party sites or their content, privacy practices, or policies.

- We may suspend or terminate your access to the Website, or your ability to place Orders, at any time, with or without notice, for breach of these Terms or for any other legitimate reason.

Governing Law & Dispute Resolution
- These Terms, and any dispute or claim arising out of or relating to them, are governed by the laws of the Province of Nova Scotia and the federal laws of Canada.
17. Severability & Waiver
- If any provision of these Terms is invalid or unenforceable under applicable law, that provision will be deleted or limited to the minimum extent necessary, and the remaining provisions will continue to be in full force.
- Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.
